Taxes are always an important consideration in a bankruptcy filing. Congress has had under consid-eration major changes in the Bankruptcy Code. It is possible, at this time, to discharge certain unfiled taxes in a Chapter 13, whereas in a Chapter 7, unfiled taxes will never be discharged. Therefore, it is critical to receive competent advice prior to filing.
Remember, there has been pending new bankruptcy legislation which is backed by banks and credit card companies. The new legislation is harsh and requires debtors to set up payment plans. It is better to file now then to face the uncertainty and a payment plan.
